Terms of Service: Ink Ease (AU)

1. Introduction & Legal Entity

This website is operated by Ink Ease. Throughout the site, the terms “we”, “us” and “our” refer to Ink Ease. Ink Ease is a 100% Australian owned and operated entity, ABN: [Your ABN Here]. By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

2. Regulatory Classification

Ink Ease products are formulated as topical cosmetics in accordance with the Industrial Chemicals Act 2019 and the Therapeutic Goods (Excluded Goods) Determination. Our formulations are designed for external skin conditioning and preparation. As our anaesthetic concentrations remain within the limits defined for cosmetic use, these products are not required to be registered on the Australian Register of Therapeutic Goods (ARTG).

No Therapeutic Claims: This product is intended for cosmetic skin preparation only. We make no claims regarding the prevention, diagnosis, or treatment of any medical condition, nor do we claim our products provide 'pain relief' in a medical or surgical context. Use of this product is at the consumer's discretion for aesthetic purposes."

3.Medical Disclaimer & Safety

  • Assumption of Risk: By purchasing our products, you acknowledge that you have read the label and will follow all directions for use.

  • Patch Test: You agree to perform a small skin patch test 24 hours prior to full application. Ink Ease is not liable for allergic reactions or sensitivities.

  • Contraindications: You represent that you are not allergic to lidocaine, prilocaine, or any listed ingredients. Consult a healthcare professional if you have heart, liver, or kidney conditions, or are pregnant/breastfeeding.

  • Professional Use: While our products are available for consumer purchase, we recommend use under the guidance of a professional (e.g., tattoo artist, dermatologist) where appropriate.

4. Australian Consumer Law (ACL) Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

  • Hygiene Exception: Due to the nature of topical health products, we cannot accept "Change of Mind" returns for any product where the tamper-evident seal has been broken or the packaging has been opened.

5. Payment & Security

Payments are processed securely via Shopify Payments. By providing payment information, you represent that you are the authorized user of the card or account. Prices are shown in AUD and include GST unless otherwise stated.

6. International Orders & Restrictions

Ink Ease ships globally; however, the customer is the importer of record. * Local Laws: You are responsible for ensuring that topical anaesthetics are legal for import into your specific country.

  • Duties: You are responsible for all local customs, duties, and taxes.

  • No PO Boxes: For international orders, physical addresses are required. Orders with international PO Boxes will be cancelled and refunded.

7. Prohibited Uses

In addition to other prohibitions, you are prohibited from:

  • Reselling Ink Ease products on third-party marketplaces (Amazon, eBay, etc.) without a formal wholesale agreement.

  • Using our products for "off-label" purposes not specified on the packaging.
